TERMS OF USE

1. INTRODUCTION

These Terms of Use determine the rules and conditions for the use of Royal M Hotels mobile application (“Application”) and regulate the rights and obligations of the Parties accordingly.

The visit and use of the Application, and all transactions that users will perform through the Application are subject to these Terms of Use.

You declare upon the acceptance of Terms of Use that you bear any legal authority and requirements to use the Application and accept Terms of Use.

ROYAL M HOTEL (“Hotel”) reserves the right to change, update and renew the entire content of these Terms of Use at any time without notice. It is the users' responsibility to follow the updates on the Application. The updated Terms of Use will be valid from the moment they are published on the Application and the use of the Application will be subject to the updated Terms of Use from that moment thereon. Therefore, please review the "Terms of Use" page regularly.

The Hotel may change, upgrade, or publish a new version of the Application, any part of its features or functions at any time. Unless otherwise explicitly and separately specified by the Hotel, any new version of the Application will be subject to these Terms of Use.

If you do not agree to these Terms of Use, please do not use the Application. Please read the Terms of Use carefully before using the Application.

The Hotel may suspend your account or terminate your use of the Application if you violate the Terms of Use; may take down any content you provide and/or initiate a lawsuit or legal action against you in case of unlawfulness.

B. GENERAL CONDITIONS

1. The Hotel cannot be held responsible for any errors, systemic slowness, or inability to use the Application that may occur due to the device and/or internet connections used by the Application Users. The User accepts that access to the Application may be temporarily blocked in order to implement improvements and other changes to the Application.

2. The Hotel or its affiliates, subsidiaries, directors, representatives, employees, and other representatives cannot be held liable for any direct, indirect, special, incidental, consequential, punitive and/or exemplary damages in any way, including but not limited to loss of profit or income, loss of data and/or business, that may arise in connection with the use or inability to use this Application, or the reliance on its content, even if the Hotel has been notified of the possibility of such damage in advance.

3. The Hotel reserves the right to remove and change the content in the Application at any time and without any reason.

4. The Hotel may prevent the use of the Application, on the condition that it reserves the legal rights of the natural/legal person or persons who take action (using software that will threaten the general security of the Application, prevent the operation of the Application and the software used, performing activities, attempting to do it, and obtaining, deleting, changing information, etc.) in situations that violate the obligations specified in these Terms of Use or the general rules stated in the Application.

5. It is forbidden to use the Application or its content for illegal purpose or purposes, to access any part of it using an automated mechanism such as a robot or warm, or to copy and monitor it for commercial/non-commercial purposes.

6. This Application may contain links to third-party applications/websites, but the Hotel is not responsible for any content of these websites. When using these applications/websites, you may need to review and approve the applicable terms of use. In addition, a link to any third-party application/website does not imply the Hotel’s endorsement of the application/website or the products or services mentioned on the application/website.

C. TERMS OF USE 

7. In order to create an Application user account, the information in the relevant registration form must be entered completely, accurately and up to date. The Hotel cannot be held responsible for any incomplete, inaccurate, or outdated information entered in the registration form.

8. After the user account has been created and the user details have been verified, users will be able to use the Application by logging in with their username/contact address and password and approving these Terms of Use. Users who do not have a user account can review the public parts of the Application, but cannot perform transactions in the Application.

9. If the Hotel has reasonable grounds to suspect that any information provided by the User is fraudulent, inaccurate or incomplete, it shall have the right to suspend or terminate the User's right to access and use the Application immediately without notice. The User is responsible for maintaining the confidentiality of all authentication information associated with accessing and using the Application. If you notice a possible misuse, loss or disclosure of your accounts or identity verification information or any security breach regarding the Application, you must immediately inform the Hotel.

10. The User accepts, declares and undertakes that he/she will comply with the Terms of Use and other provisions that may be published from time to time on the Application, law, morality and manners, and principles of honesty in all reservation and service requests to be made on the Application. The User accepts, declares and undertakes that he/she will not act by any method that may prevent the functioning of the Application and that will not violate or threaten the rights of third parties.

11. The User is directly responsible for sharing his/her usage rights such as username and password given to her/him or determined by herself/himself with third persons or organizations (also for the malicious use of his/her password by other persons). Likewise, the User cannot use someone else's IP address, e-mail address, user name, and other information in the internet environment, and cannot access or use other users' data without permission. All kinds of legal and criminal liability that may arise from the uses mentioned here belong to the User.

12. If there is any clause in the Terms of Use that you do not accept or you are not authorized to approve or accept the Terms of Use you cannot use the Application. You also declare that you are of legal age, that you are in a position to make binding agreements within the framework of legal legislation, and that you are entitled to be under the responsibility of all kinds of conditions, obligations, confirmations, proxies, and guarantees specified in these Terms of Use, that you are competent to be evaluated within the framework of these Terms of Use and to comply with these terms.

13. Reservations to be made on the Application are limited to their availability at the time of reservation. The Hotel may not be able to provide reservations if there are no available places.

14. The products and services requested through the Application are limited to the stocks and facilities of the Hotel and in case these stocks and facilities are exhausted or expired, the Hotel may not be able to provide and deliver them.

15. The right to change the price and feature information of the services offered on the Application belongs to the Hotel. If an error occurs in the price and feature information, the Hotel can inform the Users and offer its services to correct this error or cancel them.

16. The Hotel can make the free services in the Application paid services or make the paid services free, open additional services, change some of its services partially or completely, or convert them into paid services.

17. The fee of the paid services provided by the Hotel can be specified in the Application. If the services with a specified fee are selected by the User, it will mean that the User accepts the fee. The fee for the related services shall be added to the room account for the Users staying at the Hotel. In line with the Hotel's preference, a fee may be charged for the services to be determined by the Hotel, before the related service starts or at the end of the service.

18. THE HOTEL MAKES NO WARRANTIES OR CONDITIONS EXPRESS, IMPLIED, LEGAL, OR OTHERWISE, INCLUDING THE WARRANTIES AND CONDITIONS OF MERCHANTABILITY OR SUITABILITY FOR A PARTICULAR PURPOSE, IN CONNECTION WITH THESE TERMS OF USE. THE HOTEL DOES NOT WARRANT THAT THE MOBILE APPLICATION WILL BE ERROR-FREE OR UNINTERRUPTED (INCLUDING CYBER ATTACKS OR MALWARE CODE OR INTERRUPTIONS IN THE SOFTWARE) OR COMPATIBILITY WITH ANY KIND OF SOFTWARE. THE HOTEL DISCLAIMS LIABILITY FOR ANY DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF THE MOBILE APPLICATION. YOU AGREE THAT YOUR ACCESS AND USE OF THE MOBILE APP IS AT YOUR OWN RISK. YOU ACKNOWLEDGE THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR INFORMATION SYSTEMS OR ASSETS, OR LOSS OF DATA ARISING FROM SUCH ACCESS OR USE.

19. It is forbidden to perform the following operations within the scope of access and use of the Application:

• Using the Application for any fraudulent or otherwise unfair or illegal purpose.
• Continuing to use the Application despite any reason that eliminates the authorization to use the Application.
• Trying to gain unauthorized access to the application.
• Performing vulnerability or similar tests for the application.
• Collecting or attempting to collect information about other users of the application.
• Interfering with or disrupting the operation of the Application or the servers or networks used to make the Application available, including hacking or tampering with any part of the Application, or violating any requirement, procedure or policy of such servers/networks.
• Restricting or preventing another person from using the Application.
• To reproduce, modify, adapt, create derivative works, sell, rent, lend or otherwise use any part (or any use) of the application without the authorization of the Hotel.
• To reverse engineer, decompile or disassemble any part of the application.
• To act contrary to any copyright, trademark or other proprietary rights.
• To use the Application/content of the Application to develop a product or service that serves the same or similar purpose or otherwise competes with the Application.

Users are responsible for the provision, maintenance and payment of all hardware, telecommunications and other services required for using the Application.

D. INTELLECTUAL PROPERTY RIGHTS

20. All registered or unregistered intellectual property rights such as title, business name, brand, patent, logo, design, information, content and method in this Application belong to the Hotel and the third parties which provides service to the Hotel and are protected under national and international law. Downloading or using the Application does not grant any rights to the Users regarding such intellectual property rights.

21. The information in the Application cannot be reproduced, published, copied, presented and/or transferred in any way. The whole or part of the Application cannot be used on another website/application/medium without permission or against the rules specified here.

22. It is forbidden to use the Application's design, source codes, interface, content, database exactly, altered or differentiated, partially or completely.

E. PROTECTION OF PERSONAL DATA

23. As a result of activities such as receiving and fulfilling requests through the Application, and creating a user account, personal data of real persons may be processed. For detailed information regarding the processing of your personal data, please review the Privacy Statement.

F. MISCELLANEOUS

24. Istanbul (Central) Courts and Enforcement Offices are authorized to resolve disputes that may arise from the implementation of these Terms of Use.

25. All notifications to be sent to the relevant parties regarding these Terms of Use will be made through the Users' e-mail address/addresses known by the Hotel.
